Moto Action does not sell used products, or products of inferior quality to equivalent products available on the market. Important product characteristics and technical specifications can be found on the product information label. Design, colour and size of the products shown on motoactionimola.it may differ from actual products as a result of the computer monitor or internet browser used.
Prices are subject to change, check final price before sending us your order form. Please remember that in order to exercise your return rights, returned items must bear the moto action sticker and must not be damaged or altered in any way.
All products sold by motoactionimola.it are covered by the manufacturer’s conventional guarantee and by a 24 month guarantee for faulty goods, according to legislative decree no.24 of 2nd February 2002. This guarantee is reserved for private consumers (An individual who purchases products for reasons unrelated to his/her business or professional activity, or without indicating a VAT number on order form at time of purchase) and is valid for 2 years from date of delivery. The professional user can also benefit from the manufacturer’s conventional guarantee for up to one year from the delivery date, except for derogations made by the manufacturer.
In the case of faulty products, you are eligible for reparation or replacement of the product, without charge, according to the conditions outlined by article 130 of the legislative decree of 6th September 2005, no. 206 (Consumers’ Code).
For the guarantee to be valid, the faulty product must be reported within 2 (two) months after discovering the defect. The guarantee covers defects which occur up to 24 (twenty-four) months from the delivery date. The guarantee does not cover goods damaged as a result of negligence, inadequate maintenance, or incorrect use.
In order to receive a replacement product, you must report the defect within 26 (twenty-six) months from delivery date and in any case, no more than 2 (two) months after discovering the defect, by sending an e-mail (info@motoactionimola.it), fax or letter by registered post, announcing its return to: Moto Action, of Avoni Roberto, Headquarters Via Ugo Lambertini n.1B-1F 40026 Imola (BO), compiling the fac-simile form, available as a download, by clicking on the link FAULTY GOODS.
Within 3 (three) working days of receiving the aforementioned communication, you will receive an email from motoactionimola.it with a code to identify the goods when they are returned (“Return Code C…..”). Moto Action will arrange collection of goods from the indicated address within approximately 8 working days. Returned goods must be correctly packaged, including all their components, and must be accompanied by the fiscal receipt or invoice and a copy of the order confirmation, sent by e-mail by motoactionimola.it. The return code “C…” must be indicated on the box..
After receiving and checking the goods, Moto Action will repair or replace them within a suitable time scale, taking into considering the nature of the product and its defect.
You have the right to withdraw from the contract made with motoactionimola.it, without penalty or explanation, within ten (10) working days from receipt of the product purchased from motoactionimola.it. In order to withdraw form the contract you must complete the fac-simile Returns form available as a download by clicking on the RETURNS POLICY FORM link and sending it via fax or registered post, announcing its return to: Moto Action Via Ugo Lambertini n.1B-1F 40026 Imola (BO); you will receive an email from motoactionimola.it with a code identifying the returned goods (“Return Code R…..”). After this, you may return the goods to: Moto Action Via Ugo Lambertini n.1B-1F 40026 Imola (BO) with your chosen forwarder, within ten (10) working days from receipt of goods. The only expenses you will have to cover are shipping costs for returning your purchased products. Moto Action does not accept responsibility for damaged, lost or stolen goods, returned by uninsured post.
The abovementioned Returns Policy is respected when the following conditions are also fulfilled:
If you exercise your return policy rights, following the terms and conditions indicated in the paragraph above, Moto Action will reimburse the amount taken for purchased products as quickly as possible, and in any case within thirty (30) days after receiving notification of the return, will begin the returns procedure.
If the terms and conditions of the returns policy, outlined in this paragraph, are not fulfilled, you will not be eligible for a refund.
If the name of the recipient of the goods indicated on the order form does not correspond with the name of the bill payer when a return is made, the refund will always be made to the bill payer.
