GENERAL ON-LINE PURCHASING CONDITIONS
When completing and confirming your order form you are entering into a contract through an on line communication network owned by www.motoactionimola.it or www.motoactionimola.com Consumer Code Article. 50 et seq. D. Lgs. 6 September 2005, No 206. The Contract states that the sale of goods between Moto Action of Avoni Roberto, with a registered office in Imola (BO) Via Ugo Lambertini n.1, CF VNARRT63P20D360F, VAT number 00465201200, and the purchaser (the direct user of the purchased products) were made by you via the Internet. Once the proposed purchase, made by you via the Internet, has been accepted by Motorcycle Action, the contract will be considered valid. The information contained on this site, will remain valid and effective until modified and / or supplemented by Moto Action. Any changes or additions to the General Conditions will be effective from the date it was published on the motoactionimola.it homepage and will apply to any sales made thereafter.
Each item is accompanied by specific product information. All pictures representing products and data are to be considered as examples only, as actual colour and size may somewhat vary, and are subject to change without prior notice by Motorcycle Action.
Product facts and information are freely available. Moto Action does not claim responsibility for any inaccuracies regarding the details of the products, which function mainly as a means of illustration. In order to complete the process of purchasing a product, you must register your data on the site in the form of a personal code (password) and an identification code (User ID). This data is subject to the provisions of law no. 30 June 2003 196, on "Protection of Privacy regarding the processing of personal data" as stated in paragraph PRIVACY. After submitting your purchase, motoactionimola.it will send an e-mail summary, this confirmation message reports the date and time of execution and an "order number" to be used with any other communication with Moto Action . The message will contain all data entered and it is the responsibility of the purchaser to communicate any error corrections. If needed, after the placement of the order and before the order confirmation, Moto Action may contact you for further information or clarification.
The on-line contract should be considered complete when the order is accepted: Moto Action reserves the right to cancel an order and will contact the purchaser by e-mail or telephone if the product is not available from the manufacturer or if it cannot be delivered due to particular delivery problems, or in case of credit card fraud.
In cases where the merchandise is not readily available or in stock, Moto Action will promptly notify the purchaser, by e-mail or phone, and in cases where there is a depletion of stock due to excess demand or other causes, the time of order fulfilment will depend on the availability of the manufacturer and / or distributor.
To estimate the total cost of products chosen, plus shipping costs, you may add products to the cart and choose your form of payment and country destination.
You are free to choose the method of payment you prefer specified in paragraph PAYMENTS, and the method of delivery as described in paragraph SHIPMENTS. It is prohibited by law to falsify personal or financial information when ordering on-line or via any other means of communication. Moto Action reserves the right to report any violations to the appropriate authorities regarding the protection of consumers and public rights.
PRICE
The merchandise prices listed on-line, are expressed in Euros and include sales tax. For those ordering abroad, the merchandise will appear without sales tax for shipments outside Italy. Shipping costs need to be added to the price of the products purchased, as indicated in paragraph SHIPMENTS. The total cost of the order is shown before the order confirmation.
Prices may change without prior notice and it should be understood that the correct price is the one made after a confirmation from Motorcycle Action. We reserve the right to verify payment before sending the order and will include the purchase receipt or invoice inside the package. Moto Action is to be considered exempt from any invoice error resulting from issues such as incorrect information and you cannot make any changes to the data indicated in the invoice.
JURISDICTION
This contract is governed by Italian law. For any dispute concerning the validity, interpretation or execution of this contract, the responsible jurisdiction is the court of Bologna, in Italy.
